Services (ICTS) is a subsidiary of Radio Now, LLC with its registered office at
15223 Herriman Blvd., Ste. 3, Noblesville, IN 46060.
ICTS provides
services and products to you subject to the following terms, conditions, notices
and disclaimers as amended from time to time at the discretion of
ICTS.
By accessing, browsing or utilizing any or all of the services
and products within or provided by ICTS, you acknowledge that you understand and
agree to the terms, conditions, notices and disclaimers contained herein. If you
do not agree with the stated terms, conditions, notices and disclaimers, ICTS
advises that you do not use the service.
ICTS reserves the right to
amend, change or omit this site at our discretion. Additionally we reserve the
right to institute changes or amendments (effective immediately) to any or all

ICTS will in no circumstances, to the
extent permitted by law, be liable for any damages or loss whatsoever, whether
direct, indirect, punitive, special, or consequential. Nor will ICTS be liable

or the inability to use, the ICTS Web Sites, even if advised of the possibility
of such damages or that such damages were foreseeable.
Where ICTS is
unable to exclude liability for breach of terms and/or conditions of any implied

If the breach relates to products:
- The replacement of the goods or the
supply of equivalent goods
- The repair of the goods
- The payment of the cost of replacing the
goods or of acquiring equivalent goods
- The payment of the cost of having the
goods repaired
If the breach relates to services
supplied or offered:
- The supplying of the services again
- The payment of the cost of having these
services supplied again.
Ordering
An order placed by you through the ICTS
websites is an offer to purchase a particular product or service at the price
and delivery charges specified on these Web Sites. ICTS reserve the right to
accept or reject your offer for any reason. Prices and products and delivery
charges, and product and service availability are current at the time of issue
but are subject to change at any time without notification.
You must provide accurate personal
details and information and must not transmit any material of any kind which
contains a virus, malicious computer code transmitted on or through the Web
Sites or other harmful components.
Your contract with ICTS is operable
when ICTS advises that your order has been accepted and receipt of your payment
is confirmed.
Our Rights
ICTS may elect to electronically monitor
areas of the Sites and may disclose any Content, records, or electronic
communication of any kind
- To satisfy any law, regulation, or
government request
- If such disclosure is necessary or
appropriate to operate the Sites
- To protect our rights or property or the
rights of the users, our directors, employees, representatives, sponsors, third
party providers or licensors
ICTS maintains the right to suspend or
terminate access (Yours) to all or some of the Sites, without notice, in our
sole discretion.
Applicable Law
As far as legally possible this
Agreement, its terms and conditions and the Use of these Sites shall be governed
by the laws in existence from time to time in the United States.
These
Terms and your agreement, as constituted by your access, browsing or use of
these Web Sites will be governed by and construed in accordance with the laws of
the United States. You and ICTS agree to submit to the exclusive jurisdiction of
the courts of the state of the United States.
In the event that any of these Terms and
Conditions is deemed to be unenforceable or contrary in any respect under any
law then such unenforceable or invalid law shall not affect any other provision
of these Terms and Conditions. The Terms and Conditions shall be constituted as
if such an unenforceable law and contrary provisions had never been contained
herein.
Termination
These terms are effective even if this
Agreement is terminated by either party. Subject to applicable law, we reserve
the right to suspend or deny, in our sole discretion, your access to all or any
portion of these Sites with or without notice. You agree that any termination of
your access to these Sites may be effected without prior notice, and acknowledge
and agree that we may immediately deactivate or delete your account and all
related information and files under your account and bar any further access to
such files or the Sites. Further, you agree that we shall not be liable to you
or any third-party for any termination of your access to the Sites. |
